Delhi Police files an FIR under UAPA regarding lawyers’ complaint about ‘threats over PM security breach’

On Wednesday, the Delhi Police registered an FIR under different sections of the Indian Penal Code and Unlawful Activities Prevention Act (UAPA). This was based on lawyers’ complaints that they received threats to judges regarding the case relating to Prime Minister Narendra Modi’s security breach.


Vishu Shankar Jain (Lawyer in Supreme Court) stated that one of the complainants was registered by Special Cell of Delhi Police to file an FIR based on his complaint.

He said that the FIR was filed under sections 153 (Wantonly provoking riot), and 153A (Promoting hatred between different groups on the grounds of religion, race or place of birth and doing acts prejudicial towards maintenance of harmony), and 506 (Punishment to criminal intimidation). These sections are read together with UAPA 13, 16, 18, and 20.

The Supreme Court has received threats from several lawyers regarding the case in which Prime Minister Narendra Modi was stuck for 20 minutes at a Punjab flyover on January 5, 2022.

According to the Supreme Court Advocate-On-Record Association’s (SCAORA) correspondence, the calls were allegedly made by a pro-Khalistan organization Sikhs for Justice.

Wednesday’s Supreme Court meeting established a committee under Justice Indu Malhotra, a former top court judge. This committee will investigate the security breach that occurred during Prime Minister Narendra Modi’s visit to Punjab.

A Bench consisting of Chief Justice of India NV Rajana, Justices Surya Kant and Hima Kohli established the independent Committee. They stated that a matter relating to breaching security of Prime Minister cannot have been decided by a “one-sided inquiry” by the State government or Centre and must be handled by a “judicially trained person”.
