SC extends stay against Noida CEO Ritu Mahashwari to May 13

On Wednesday, the Supreme Court extended the stay on the Allahabad High Court’s non-bailable warrant against Noida Chief executive Officer (CEO), and IAS officer Ritu Mahashwari to Friday (May 13). This was in connection with her contempt proceedings.
Justice S Abdul Nazeer, Justice Krishna Murari and Justice Krishna Murari adjourned to the matter until Friday. They asked to list it before “any appropriate court” upon receiving directions from the Chief Justice.
The Supreme Court on Tuesday stayed Maheshwari’s non-bailable warrant.
A bench headed NV Ramana, Chief Justice of India, stayed the Allahabad High Court Order that issued a nonbailable warrant for Ritu Maheshwari (CEO, New Okhla Industrial Development Authority) Gautam Budh Nagar. The matter was then scheduled for Wednesday.

Senior Advocate Mukul Rohatgi stated that Maheshwari was requesting a stay of the non-bailable warrant. This is a gross case in which a “passover was sought”. The HC ruled that this was gross contempt, and gave the order asking Maheshwari to appear in custody.
Allahabad HC issued a not-bailable warrant against Ritu Mahashwari on May 5 and ordered that she be brought in police custody prior to the court’s May 13 hearing.
Allahabad HC issued the order after Maheshwari did not appear before it in connection to contempt proceedings against Maheshwari.
Maheshwari failed to appear before the court at the time the matter was being considered. This led her counsel and her to ask the court not to consider the matter until Maheshwari appeared in court, as her flight was delayed.
“This court finds CEO, NOIDA’s conduct to be deliberate and willful disrespect of the court. As the Officer of the rank Chief Executive Officer of a Corporation expected that the court would take up the matter at her whim, this court finds it to fit the case for a non-bailable warrant to be issued against CEO, NOIDA,” the HC stated.
